1. Agreement to Terms

By accessing and using Accale ("we," "our," or "us"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use this service.

2. Description of Service

Accale is a social media automation platform that streamlines the lifecycle of campaigns on Instagram and YouTube. By integrating with your social accounts and leveraging AI, Accale helps you plan, create, schedule, and publish content while monitoring performance.

What Accale Does

  • Account Integration: Connects to your Instagram and YouTube accounts to sync profile metadata and enable automated workflows
  • Campaign Strategy: Lets you define goals (e.g., Brand Awareness, Engagement, Lead Gen), select platforms, and set KPIs such as follower growth, engagement rates, and view duration
  • Content Planning: Provides a visual calendar to plan and schedule posts; an asset repository for images and videos; and AI-powered suggestions for captions, tags, and optimal posting times
  • AI-Powered Optimization: Uses OpenAI models to analyze your content and performance data to generate recommendations and improve future campaigns
  • Approval Workflow: Requires your explicit approval before any content is published—no automated posting without your authorization
  • Performance Monitoring: Continuously collects engagement metrics and feeds insights back into the AI to refine recommendations for future content cycles

3. User Accounts

To use Accale, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

4. Human-in-the-Loop and Your Responsibilities

Accale operates on a human approval model. Before any content is published to Instagram or YouTube:

  1. Generation: Accale prepares posts, captions, and scheduling metadata using AI
  2. Review: You review and may edit the proposed content
  3. Approval: You explicitly approve content for publishing
  4. Publishing: Only after your approval does Accale publish to your connected platforms

You are responsible for:

  • Reviewing and validating all AI-generated content before approval
  • Ensuring content complies with applicable laws and platform policies (Instagram, YouTube)
  • Not using Accale to violate any platform's terms of service or community guidelines

We do not guarantee the accuracy, completeness, or suitability of AI-generated content. Do not rely solely on AI output for critical decisions.

5. Third-Party Platforms and Integrations

Accale integrates with Instagram, YouTube, and OpenAI to provide its services. By using Accale, you acknowledge that certain data may be shared with these services as described in our Privacy Policy. See Section 6 (Third-Party Integrations) of our Privacy Policy for details.

Platform Terms Compliance

Accale follows and respects each platform's terms of service. Your use of Accale is also subject to:

You must comply with these platform terms when using Accale. Connecting your accounts constitutes your authorization for Accale to act on your behalf within the scope of the features you use.

Instagram

When you connect Instagram, Accale may view account metadata, publish posts/reels/media you approve, access engagement metrics, read comments, and retrieve analytics. You may disconnect at any time via Instagram account security settings or the Accale integrations dashboard. Disconnecting stops all future automation.

YouTube

When you connect YouTube, Accale may view channel metadata, upload videos you approve, set titles/descriptions/tags, access video analytics, and organize playlists. You may revoke access at any time via Google Security Settings or the Accale integrations dashboard. Use of YouTube is also subject to Google's Privacy Policy.

OpenAI

Accale uses OpenAI models for content suggestions, campaign strategies, and scheduling recommendations. Data you provide (campaign goals, content ideas, performance insights) may be sent to OpenAI for processing. Your data is not used to train public AI models. See our Privacy Policy for full details.

6. Acceptable Use

You agree to use Accale only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or connected accounts
  • Interfere with or disrupt the service or servers
  • Upload or transmit viruses or malicious code
  • Harass, abuse, or harm others
  • Violate any applicable laws, or the terms of Instagram, YouTube, or other platforms

7. Intellectual Property

Accale and its original content, features, and functionality are owned by Accale and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create and upload. You grant Accale a limited license to use, store, and display such content as necessary to provide the service.

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and disclose your information, including data shared with Instagram, YouTube, and OpenAI. By using Accale, you consent to those practices.

9. Subscription and Payment

Certain features may require payment. By purchasing a subscription:

  • You agree to pay all applicable fees as described on our platform
  • Subscriptions automatically renew unless canceled
  • You may cancel your subscription at any time
  • Refunds are provided according to our refund policy

10. Limitation of Liability

In no event shall Accale, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

11. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. Accale expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to defend, indemnify, and hold harmless Accale and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the service or your violation of these Terms or any platform terms.

13. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason including breach of these Terms.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Accale operates, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
